Terms & Conditions

Effective: May 2026 | Subject to Kenyan Law

  1.  Introduction

These Terms and Conditions (‘T&Cs’) constitute a legally binding agreement between Siraam Tours &
Travels (‘the Company’, ‘we’, ‘us’, ‘our’) and you, the client (inclusive of all participants registered under
your booking). By confirming a booking with us, you confirm that you have read, understood, and accepted
these T&Cs in full, and that you are duly authorized to bind all participants named in the booking.
These T&Cs are governed by and construed in accordance with the laws of Kenya, including the Tourism
Act (Cap. 383), the Consumer Protection Act, and any applicable Kenya Tourism Board guidelines. They
apply to all bookings made via our website, at our offices, through agents, or on any digital platform.
The applicable T&Cs are those published at the time your booking is confirmed. Our full contract with you
comprises these T&Cs together with: our brochures and website information, your confirmed itinerary, price
lists, booking invoices, and any written amendments agreed between the parties.

2. Booking & Confirmation

Booking Accuracy
• All clients must provide full legal names, nationalities, and dates of birth exactly as they appear in
their passports or travel documents.
• Inaccurate information may result in denied boarding, entry refusals, or additional costs — for which
the Company bears no liability.
• Any special requirements (dietary, medical, mobility needs) must be declared at the time of booking
and confirmed in writing.

Accommodation
• If your chosen accommodation becomes unavailable for reasons beyond our control, we will
propose a comparable alternative at no additional cost to you.
• Accommodation is based on two persons sharing a twin room or tent. Single supplements apply for
solo occupancy and will be communicated at the quotation stage.
• Lodges and tented camps are categorized as Economy (budget), Comfort (mid-range), or Luxury,
and will be specified in your itinerary.

Binding Contract
• A booking becomes binding upon receipt of your deposit and the issuance of a written confirmation
by Siraam Tours & Travels.
• By paying the deposit, you confirm acceptance of these T&Cs on behalf of all participants.

3. Payment Terms

General Tour Deposits & Balances
• A deposit of 35% of the total tour price is required to confirm a general tour or package booking.
• The full balance is due no later than 4 weeks (28 days) before the scheduled departure date.
• Bookings not paid in full by the due date may be subject to automatic cancellation without refund of
the deposit.

Safari Deposit Schedule
The following deposit structure applies to all safari and wildlife tour bookings:

 NOTE: Full payment is required at the time of booking for all last-minute reservations made within 5
days of the tour/safari start date.

Accepted Payment Methods
• Credit/Debit Card (Visa, MasterCard, and Amex): A bank processing surcharge of 3.6% applies.
Payments can be made online or at our Nairobi office.
• Bank Transfer / SWIFT: All bank charges, correspondent bank fees, and transfer costs are at the
client’s expense. Transfers must be made to our Kenya-based accounts only.
• Mobile Money (e.g., M-Pesa): Accepted for local clients. Transaction fees apply.
• Cash Deposit: Accepted at our Nairobi office. Bank deposit fees are non-refundable.
 NOTE: Siraam Tours & Travels operates bank accounts in Nairobi, Kenya ONLY. We do not hold
accounts in any other city or country. Please be vigilant against fraudulent communications requesting
payment to overseas accounts.

4. Cancellation Policy

Cancellation by the Client
All cancellations must be submitted in writing to Siraam Tours & Travels via email, WhatsApp (with written
acknowledgement), or a hand-delivered letter. Verbal cancellations are not accepted.

The following cancellation penalties apply:

Penalties are calculated as a percentage of the total confirmed tour price.

Exceptions to Cancellation Penalties
• No penalty will be applied where a Government travel advisory or warning (issued by the Kenyan
government or your home country’s foreign affairs department) restricts travel to your destination
due to war, civil unrest, epidemic/pandemic, or natural disaster — provided the warning was issued
after your booking was confirmed and within 14 days of your departure.
• In the event of serious illness or bereavement of a participant, official documentation (medical
certificate or death certificate) must be provided. Special terms may be applied at the Company’s
discretion.
• We strongly recommend comprehensive travel insurance to cover unforeseen cancellation costs
(see Section 10)

Partial Amendments (Shorter Stays / Reduced Participants)
• Reducing the duration of your tour or the number of participants constitutes a partial cancellation.
• The applicable cancellation fee will apply to the affected portion of the booking.
• A review fee may apply for significant amendments made after confirmation.

Cancellation by the Company
• In the unlikely event that the Company must cancel your tour, you will be offered the choice of a full
refund or an alternative tour of equivalent value.
• Where possible, we will notify you at least 14 days before departure.
• In cases of force majeure (including natural disasters, acts of God, government restrictions,
pandemics, or civil unrest), we will refund amounts paid. Still, we cannot be held liable for additional
compensation, including airfare, visas, or consequential losses

5. Travel Documents

• Upon receipt of final payment, we will issue all necessary travel documentation, including: tour
vouchers, confirmed itineraries, accommodation confirmations, and applicable activity permits.
• Guided safari tours typically issue documentation at the start of the tour rather than in advance.
• Electronic documentation (e-vouchers) is accepted by all partner lodges and parks.

6. Passport, Visa & Entry Requirements

• All clients must hold a passport valid for at least 6 months beyond the date of departure from Kenya.
• Visa requirements vary by nationality. It is your responsibility to obtain the correct visa before travel,
unless we have expressly agreed in writing to assist.
• Kenya operates an Electronic Travel Authorisation (eTA) system for most nationalities. We
recommend applying at least 72 hours before departure at the official Kenya eTA portal
(www.etakenya.go.ke).
• While visas on arrival may be available for certain nationalities, significant delays can occur at ports
of entry. Pre-arrival processing is strongly advised.
• The Company cannot be held responsible for denied entry or deportation resulting from inadequate,
expired, or incorrect documentation.
 NOTE: Immigration and visa regulations in Kenya and Tanzania are subject to frequent updates.
Clients are advised to consult the official Kenya Immigration Service website or their nearest Kenyan
embassy/consulate for the most current requirements.

7. Health, Vaccinations & Wellbeing

• Clients are responsible for ensuring they are medically fit to participate in all activities included in
their chosen tour.
• A yellow fever vaccination certificate is mandatory for entry into Kenya if you are arriving from a
yellow fever endemic country. Other vaccinations (e.g. hepatitis A, typhoid, meningitis) are strongly
recommended — consult a travel health clinic at least 6 weeks before departure.
• Anti-malarial prophylaxis is recommended for most safari destinations in Kenya and Tanzania.
Consult your healthcare provider for appropriate medication.
• Clients with pre-existing medical conditions must disclose these at the time of booking to allow us to
assess suitability and make necessary arrangements.
• For high-altitude itineraries (e.g., Mount Kenya, Kilimanjaro), clients must be aware of altitude
sickness risks and follow the guide’s instructions at all times.
• The Company is not a medical provider and cannot be held liable for health complications arising
during tours.

8. Pricing & Price Variations

All prices are quoted in US Dollars (USD) unless otherwise stated on your invoice. Local payments
may be accepted in Kenyan Shillings (KES) at the prevailing rate on the date of payment.
• Prices are based on prevailing exchange rates, national park fees, government levies, and fuel
costs at the time of quotation.
• Kenya Wildlife Service (KWS) park fees, conservation levies, and government taxes are subject to
change without notice. Any increases effective at the time of travel will be passed on at cost.
• Price adjustments will be communicated to you in writing before or at the time of your booking
confirmation.
• Once full payment has been received, prices will not be increased except in cases of governmentmandated surcharges (e.g., new fuel levies, new park fee structures) imposed after payment.

9. Itinerary Changes & Flexibility

 Minor Amendments
• Safari itineraries are subject to modification due to weather conditions, road accessibility, wildlife
movement, park regulations, or local community events. These changes do not constitute a breach
of contract, and no compensation will be payable.
• Kenya’s wildlife is wild and free-ranging. Game sightings, including the Big Five, cannot be
guaranteed.


 Major Changes
• In the event of a significant change to your confirmed itinerary (e.g., change of main destination,
removal of a key activity), we will notify you as soon as practicable and offer alternatives or an
appropriate adjustment to the tour price.
• Clients wishing to make changes to confirmed bookings must submit requests in writing.
Amendment fees may apply.
• Special requests (dietary, accommodation preferences, and activities) must be noted on your
booking invoice at the time of confirmation to be honored. We cannot guarantee special requests
received verbally or informally.

10. Travel Insurance

Comprehensive travel insurance is mandatory for participation in all Siraam Tours & Travels packages.
Your policy must cover, at a minimum:
• Emergency medical treatment and hospitalization
• Medical evacuation and repatriation to your country of residence
• Trip cancellation and curtailment
• Loss, theft, or damage to personal baggage and equipment
• Personal liability
• Adventure and safari activities (including game drives, walking safaris, and boat trips)
We reserve the right to decline participation to clients who cannot demonstrate adequate travel insurance
coverage before departure.
 NOTE: Insurance policies purchased within Kenya may not provide adequate international
coverage. We recommend obtaining a policy from your home country before travel.

11. Limitation of Liability

• The Company acts as a tour organizer and agent for transport, accommodation, and activity
suppliers. We do not own or operate the vehicles, lodges, aircraft, or parks used in your tour.
• The Company’s maximum liability to any client shall not exceed the total price paid by that client for
their tour.
• We disclaim all liability for personal injury, illness, death, property damage, loss, delay, or
inconvenience arising from the acts or omissions of third-party suppliers, except where such loss
arises directly from our own gross negligence or willful misconduct.
• The Company’s liability for passenger transport within Kenya is governed exclusively by Kenyan
law. No overseas jurisdiction applies.
• The Company shall not be responsible for loss or damage to personal luggage or equipment at any
point during the tour.

• All written claims must be submitted to the Company within 28 days of the tour’s completion. Claims
submitted after this period will not be entertained.
• Where the Company makes settlement payments to a client, the client agrees to assign any
corresponding rights or claims against third parties to the Company or its insurers.

12. Client Responsibility & Code of Conduct

• By booking with us, you confirm that all participants are physically and mentally fit to undertake the
chosen itinerary and activities.
• Clients are expected to behave respectfully toward Company staff, guides, drivers, lodge personnel,
local communities, and wildlife at all times.
• Any client whose conduct is deemed disruptive, offensive, illegal, or dangerous may be removed
from the tour at the Company’s discretion, with no right to a refund for unused services.
• Kenya’s wildlife laws are strict. Feeding, disturbing, or approaching wildlife unsafely is a criminal
offence. Clients must follow the guide’s instructions at all times during game drives and walking
safaris.
• Respect for local cultural norms, dress codes (especially at coastal and religious sites), and
community protocols is expected.
• Plastic bag use is prohibited in Kenya. Clients are encouraged to use reusable bags and minimize
their environmental footprint throughout their journey.

 Clients with Disabilities or Special Needs

• We are committed to making our tours accessible. Clients with mobility impairments or other special
needs must inform us at the time of booking to enable us to assess suitability.
• Most safari environments involve uneven terrain, bush tracks, and facilities with limited wheelchair
access. We will make every reasonable effort to accommodate needs, but we cannot guarantee full
accessibility at all locations.
• Self-reliance is generally expected on safari. Please consult us in advance to ensure your chosen
tour is appropriate.

13. Safari Vehicles & Transport

• Standard safari transport consists of purpose-built pop-up roof 4×4 Land Cruiser jeeps, which
provide optimal game-viewing conditions.
• Customized safari vans are available for certain itineraries at discounted rates, as specified in your
quotation.
• The Company reserves the right to utilize certified subcontracted vehicles of equivalent standard
where necessary, without prior notice.
• Driver/guides fluent in English, German, French, Italian, and Spanish are available upon request.
Please specify language preferences at the time of booking.
• Safari vehicles are equipped with first aid kits, communication equipment, and emergency tools in
compliance with Kenya Tourism Board requirements.

14. Safari Cost Inclusions & Exclusions

• 4×4 safari vehicle hire and fuel for the confirmed itinerary

• Meals as stated in your itinerary (typically full board at lodges and tented camps)
• Accommodation at the specified lodge, tented camp, or hotel
• Kenya Wildlife Service (KWS) national park and game reserve entrance fees as per itinerary
 Excluded from Your Safari Price
• International and domestic airfares (unless specifically stated)
• Airport departure taxes and security levies
• Visa and eTA fees
• Travel insurance premiums
• Personal items: laundry, mini-bar, telephone, souvenirs
• Gratuities for guides, drivers, and lodge staff (customary but not mandatory)
• Any activities or excursions not listed in your confirmed itinerary
• Personal medical expenses

15. Taxes & Local Fees

• Prices include pre-collected taxes, levies, and government tariffs where stated in your invoice.
• Certain fees — including KWS park entry fees, airport passenger service charges, and conservation
levies — are collected locally and may be subject to change before or during your tour. Such
changes will be payable by the client at the prevailing rate.
• All prices include Kenya’s Value Added Tax (VAT) at the applicable rate, where applicable.

16. Responsible Tourism & Sustainability

Siraam Tours & Travels is committed to responsible and sustainable tourism in line with Kenya Tourism
Board guidelines and the principles of the Global Sustainable Tourism Council (GSTC). We encourage all
clients to:
• Support community-based tourism initiatives and purchase locally made crafts and products.
• Conserve water and energy at lodges — Kenya’s ecosystems depend on sustainable resource use.
• Avoid single-use plastics — banned in Kenya’s national parks and conservation areas.
• Respect wildlife habituation zones and maintain safe distances from animals.
• Choose Fair Trade certified products and services where available.
• Report any wildlife poaching or illegal activity observed during your tour to your guide immediately

17. Complaints & Dispute Resolution

• Any complaints or concerns arising during your tour should be reported immediately to your
driver/guide or tour manager (in writing via email or WhatsApp) to allow for on-site resolution.
• If your concern is not resolved satisfactorily during the tour, a written complaint must be submitted to
Siraam Tours & Travels within 30 days of the tour’s completion. Complaints received after this
period will not be considered.
• The Company will acknowledge receipt of your formal complaint within 5 business days and provide
a substantive response within 30 days of receipt.
• Unresolved disputes may be referred to the Kenya Tourism Board (KTB) Tourism Complaints
Resolution Framework, or to a mutually agreed mediator before initiating legal proceedings.

• All legal disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, under
the laws of Kenya.

18. Data Privacy & Protection

• The Company collects and processes personal data strictly for tour administration, booking
management, and legal compliance with Kenyan law, including the Data Protection Act, 2019.
• Your personal data will not be shared with third parties except where necessary for the delivery of
your tour (e.g., lodges, park authorities, airlines) or where required by law.
• You have the right to access, correct, or request deletion of your personal data at any time by
contacting us in writing.
• Booking data (including passport details) may be retained for up to 5 years for legal and auditing
purposes

19. Amendments to These Terms & Conditions

• The Company reserves the right to update these T&Cs from time to time to reflect changes in
Kenyan law, tourism regulations, or industry best practice.
• The T&Cs in force at the date of your booking confirmation shall govern your contract with us,
regardless of subsequent changes.
• Clients will be notified of any material amendments at the time of booking or as soon as practicable.

20. Acceptance of Terms

By proceeding with a booking and paying a deposit to Siraam Tours & Travels, you confirm that:
• You have read, understood, and agree to be bound by these Terms & Conditions;
• You are 18 years of age or older, or have obtained parental/guardian consent;
• You are authorized to accept these T&Cs on behalf of all participants in your booking;
• You understand the cancellation, refund, and insurance requirements set out herein.
